The pronouncement of the Hamburg regional court in its verdict of 12.05.1998 - 312 O 85/98 - "Liability for Links" was that a company/person putting down a link is, as the case may be, jointly responsible for the content of the linked page. According to the regional court, this can only be avoided by expressly setting oneself apart from the contents.

On our Home page we have set up links to other pages on the Internet. The following applies to all these links: " We wish to expressly emphasize that we have no influence at all on the configuration and contents of the linked pages. That is why we formally set ourselves apart from the entire content of all the linked pages on our entire Web site, incl. all sub-pages.

This holds good for all links set up on our Home page and for all contents of the pages to which links or banners lead."
